The Allahabad High Court has appointed an advocate commissioner to physically survey Gulmohar Greens housing society in Ghaziabad following conflicting claims by residents and the Ghaziabad Development Authority (GDA) regarding construction changes, 112 additional flats and the project's completion certificate (CC).
The commissioner is scheduled to inspect the residential society on September 19 and 20. The court has asked for details including the total number of towers, floors in each tower, flats on each floor and the number of completed and under-construction units. The findings will be considered during the hearing scheduled for September 30.
The dispute centres on the sanctioned layout. The 2006 plan provided for 35 towers and 904 dwelling units, while 34 towers were eventually constructed. Residents have alleged that subsequent changes resulted in 112 additional units and raised concerns about construction without their written consent. GDA has disputed these claims and said the compoundings were granted according to the applicable rules.
The court's physical survey is intended to establish the actual position at the site rather than relying only on competing claims and documents.
The case highlights why buyers should verify sanctioned plans, completion certificates, approved construction and project documents before purchasing property.
